Inadequate Security: What Are Your Rights if You’ve Been Injured?

In some cases, it can be clear that a property owner was at fault in an injury case. If a property owner failed to put up signs abut renovations, for example, or failed to properly maintain their Hollywood or Florida property, plaintiffs can seek damages for injuries caused by that negligence. But what happens if your injury was caused by a third person or criminal? Do you have an inadequate security claim? How much security does a property owner have to have to show they aren’t negligent?

First, it’s important to understand what a negligent security claim is. This sort of legal action usually happens after someone is the victim of a crime, such as battery, assault, rape, mugging, or another violent crime that leads to injuries. In these cases, the injured party can pursue legal action against the perpetrator and can help police in criminal charges against the perpetrator. Plaintiffs may also have a claim against the property owner.

How Do I Know Whether I Have a Claim?

You may have a claim if you and your attorney can show that a property owner knew about dangerous conditions in their area or near their property and did not take adequate steps to keep visitors to their property safe. For example, if a business owner knew that there has been a rash of criminal activity near their business but did not do anything to keep visitors safe and you were injured in a mugging or other criminal activity while on the property to conduct business, you may have a claim. You may be able to note that the property owner didn’t install a security system, had poor lighting in parking lot areas, or otherwise failed to respond adequately to the dangers.

Should I Pursue a Claim?

If you have suffered an injury during criminal activity and think you may have a negligent security claim, you’ll want to speak to a personal injury attorney. Being attacked is frightening and if you have sustained an injury you may have to pay for medical bills or you may have to lose time away from work due to your injuries or trauma. Seeking damages can help you pay for some of these costs and can help pay for treatment so you can make a fuller recovery from the attack.

Pursuing a claim is also important in creating a safer community. Holding negligent people and businesses accountable for their actions can help bring about changes. A property owner who faces legal action because of a negligent security claim may take steps to improve lighting or install a security system – precautions that could help prevent crime later on. When people speak out against unsafe situations, changes can be made so that others can be kept safe.
